What happened

The client in Phuket wanted to divorce by mutual consent. Before registering the divorce, the couple needed to settle the division of marital assets, responsibility for shared debts and parental arrangements for their child. The aim was to reduce conflict and record an arrangement that considered the child's welfare.

What we did

  • We advised on the assets and debts in the couple's circumstances and discussed parental authority with the child's interests in mind.
  • We drafted an agreement to accompany the divorce registration, setting out the asset division, debt arrangements and parental terms.
  • We reviewed the wording with the parties until both accepted the terms and checked the relevant legal requirements.
  • We prepared the documents needed to register the agreed divorce with the local registration office in Phuket.

The outcome in this case

The couple completed a divorce by mutual consent, with a written agreement covering their assets, debts and child arrangements. Rather than leaving those matters to be worked out later, they had recorded the agreed responsibilities as part of the registration process.
